Greetings,
I start this New Year's message with a close-up look at the current situation in the Ukraine surrounding Yulia Tymoshenko's imprisonment. We spent the greatest portion of 2012 ensuring that we understand how to identify War Criminals who are actively committing crimes against humanity. We revealed the geographic pattern they have created and their political priority of establishing same-sex marriages world-wide. These criminals will reveal their Ukrainian ties in 2013 which has created the biggest political scandal in the history of the Verkhovna Rada.
Currently, Yulia Tymoshenko has called the new Criminal Procedure Code that went into effect in November 2012 an "anti-reform". The new Code of Criminal Procedure was adopted by the Verkhovna Rada on the evening of April 13, 2012. The opposition argued that the new code was adopted in violation of parliamentary procedures and the public urged the president not to sign it. However, Viktor Yanukovych ignored the citizens of Ukraine and signed it into law within a month.
Under the new law, law enforcement without orders from an investigator can search a home, install video surveillance cameras, and read private mail. Authorities can also open a criminal investigation against a citizen without informing him or her.
The new code also expands the powers of investigators, allowing them to conduct undercover investigations without a criminal case against a person, in effect destroying the institution of defense. Defense council without permission and sanctions from the investigator can only be present during investigative activities.
Also, a judgment by the European Court of Human Rights in Tymoshenko v. Ukraine recognizing the political motives behind the prosecution of Yulia Tymoshenko will increase external pressure on the Ukrainian authorities to demand the release of Yulia Tymoshenko, the former Prime Minister's daughter, Eugenia Tymoshenko, has said.
Eugenia Tymoshenko said she expects a decision from the European Court of Human Rights in early 2013 similar to the one in Yuriy Lutsenko's case. "In some ways, it could maybe even have stronger wording," she suggested in an interview with the Kyiv Post. She also said that if the government fails to implement the European Court's decision, "the Council of Europe will have to specify how this decision must be fulfilled in Ukraine."
"Yulia Tymoshenko and Yuriy Lutsenko are hostages of political terrorists, who have been illegally trapped and deliberately isolated from political life in the country," Eugenia Tymoshenko added.
